International Commission of Jurists (ICJ): Ethiopian Leaders to Face a Trial for Genocide

Ogaden2The International Commission of Jurists (ICJ) reported to have begun to work to bring Ethiopian authorities to justice for having committed a genocide in the Ogaden region. The International Commission of Jurists is a known international human rights organization composed of jurists (including senior judges, attorneys, and lawyers). The commission is known for its dedication to ensuring respect for international human rights standards through the law.
The report came right after different Swedish TV channels showed a movie smuggled out from Ogaden by an Ethiopian refugee, who had been a government official in the region. The 100 hours long movie is said to have many evidences of genocide committed by the Ethiopian government in the region.
Speaking to journalists, Stellan Diaphragm, the commissioner of the Commission, said that he would do everything necessary to bring the case to the International Criminal Court (ICC).
Reports indicate that although Ethiopia is not a member of the ICC, the country can possibly face trial for crimes under international law.
The Ogaden region is a territory in Eastern part of Ethiopia, and populated mainly by ethnic Somalis. Since 2007, the region has been a site of brutal struggle between the government troops and the Ogaden National Liberation Front (ONLF), a rebel group seeking for more autonomy for the region.
Different human right organizations accuse the Ethiopian government of committing grave human right violation (including genocide) against the civilians in attempt to control the ONLF’s public support.
According to the Genocide Wach, the crimes committed in the region include extrajudicial killings, arbitrary detention, rape, torture, disappearances, the destruction of livelihood, the burning of villages and the destroying of life stock.

Residents in Gambella set Indian-owned farm on fire

Residents of the Gambella Regional State, Godera woreda, attacked and set the property of the Indian farm, Verdanta Harvest Plc., on fire on account of destroying the rich forest resources in the woreda where Verdanta has some 5,000 hectares for tea plantation.
According to sources in the area, the vigilantes attacked the plantation compound on Tuesday late night and set ablaze stores, fuel tankers, machineries like tractors and excavators and logs of timber, allegedly harvested from the land the company took for tea plantation. Gatlowak Tute, president of the region, confirmed the occurrence and said that a 9-man team has been sent to the area to investigate the event. “So far, security forces have taken into custody few locals suspected of involvement in the incident,” Gatlowak told The Reporter. 
Verdanta took over the plantation five years ago from the Ministry of Agriculture on a 50-year lease contract with fairly cheap terms. According to the contract signed at the time, the company agreed to pay 111 birr annual lease price for the plantation extending 3012 hectares wide in Godera woreda and Gumare kebele. The total lease quotation of 16.7 million birr was agreed to be payed over the course of the 50 years at 334,332 birr per annum.
However, Verdanta requested the land for tea plantation before the ministry took over the land provision from the region and hence was able to receive 5,000 hectares although the contract with ministry say 3012. According to sources, the company have kept control of the 5,000 hectares until present, which residents of the area consider to be a forest resource and national forest region. The two kebeles of Godera woreda, Gomare and Kubu, are among the 58 primary national forest regions in the country. According to residents in the locality, the area is also rich in forest agricultural productions like honey, spice and coffee.
The vigilant residents say that the plantation company was offered is indeed a forest area that deserves to be preserved. Whereas both the regional government and the ministry say that the plot of land is no more than scattered bushes and that it does not qualify to be called a forest. According to the Food and Agricultural Organization (FAO) standards, a forest area can be referred to as such as long as it is at least half a hectare wide and have trees more than five meters tall. Residents say that even the plot that is held by the Verdanta is 5,000 hectares and that it has tree which are 10 meters tall in length. At one time former president of the republic, Girma Woldegiorgis appealed to both the ministry and the region not give the land which should be preserved as national forest area. Tea plantation require the entire vegetation to be cleared out from the area, hence the president appealed to reconsider the decision. However, both the ministry and regional administration did not want to accept the request and hence the company stayed in possession of the property until the incident.
On the other had, the widespread rumors accusing the Verdanta of harvesting timber from the forest while it was supposed to be planting tea was also not accepted by the authorities. Sources say that on quite various occasions authorities have discovered logs of timber products leaving the property of Verdanta. However, the regional president did not deny this but said that the company have has assured his administration that the timber is not for sale. Although not verified by the findings of the investigating committee yet, sources indicate that it was the vigilantes of Godera who have taken matters into their own hands.
Development Bank of Ethiopia (DBE) have provided 89.5 million birr in loans to Verdanta. Hence, some are asking if DBE collateral has been damaged in the process. Efforts to get response from the Bank was not fruitful, and other are also asking if the investigative committee could come up with an amicable solution for the residents and the company in question.

Ethiopia bans citizens from travelling abroad for work

Ethiopia's government has temporarily banned its citizens from travelling abroad to look for work, the state-run Erta news agency reports.
The foreign ministry was quoted as saying countless Ethiopians had lost their lives or undergone untold physical and psychological trauma because of illegal human trafficking.
The decision was meant to "safeguard the well-being of citizens", it added.
The travel ban will remain in place until a "lasting solution" is found.
The ministry said the government had taken various measures to limit the suffering of its citizens, including setting up a national council and a taskforce to educate them.
But those measures had not been able to address the problem sufficiently, it added.
Employment agencies will also be barred from facilitating travel abroad.
The scarcity of work opportunities is a major factor fuelling emigration from Ethiopia, which has Africa's second largest population. Youth unemployment is officially estimated at more than 50%.
Human rights activists also say a significant number of those classified as economic migrants flee the country because of political and economic oppression or ethnic discrimination by the state.
Many Ethiopians try to reach Saudi Arabia, travelling via Yemen by sea and entering the kingdom illegally. Thousands of others head for South Africa, Israel and Europe.
They often end up being smuggled, trafficked or subjected to mental and physical torture. And once they reach their destinations, many require humanitarian assistance or face a wide range of abuses from employers.

A few months later, he received basic military training in Eritrea. In April 1981, Dawud commanded the OLF unit that started the armed struggle in Welega Province.
In December 1981, the Derg poisoned and then tortured him for several months. From August 1982 to December 1986, he was jailed at Kerchele prison without charge. Dawud escaped and rejoined the OLF. In 1988 he was re-elected to the OLF's Central Committee and the Executive Committee, and until 1991 headed the OLF's military department. In 1998, he was re-elected to the OLF's Executive committee and in 1999 became the OLF's chairman .

African rule of law declines despite economic gains, Ibrahim index shows

October 23, 2013 (The Guardian) — African countries have experienced widespread human development and improved economic opportunities since 2000, but the rule of law has deteriorated in a number of countries, according to the Ibrahim index of African governance (IIAG).
The annual index, published on Monday by the Mo Ibrahim Foundation, was established by the Sudanese philanthropist in 2006 to chart Africa‘s development progress.
The 2013 edition found that 94% of people in 52 countries – Sudan and South Sudan have been excluded for a second successive year due to lack of available data – lived in a country that had demonstrated improved overall governance since the turn of the century. However, average scores in the category looking specifically at safety and the rule of law showed a marked decline.
“If this deterioration is not turned around, it could signal an era where, despite fewer regional conflicts, we will see an increase in domestic social unrest across Africa,” Mo Ibrahim wrote in a foreword to the report.
Ibrahim said the index presented a “mixture of overall progress but increased complexity”, as it showed vast differences between countries and highlighted the challenges faced by governments in sustaining that progress.
“Eighteen of the 52 countries analysed saw their best ever performance in this year’s IIAG. But these figures, of course, also reveal the challenges of sustaining progress and underline that an equitable allocation of resources must be a priority for policy and decision makers,” he added.
The index marks countries for their progress in four categories: human development, participation and human rights, sustainable economic opportunity, and safety and the rule of law.
There were no surprises at the top- and bottom-ranked countries overall. At the upper end of the scale, Mauritius was followed by Botswana, Cape Verde and Seychelles. These four countries have shared the four top slots, in various positions, since the index was launched in 2007.
Somalia was the poorest performing country overall and in all four categories, a position it has held for the past seven years. Second from bottom was the Democratic Republic of the Congo (DRC), followed by Eritrea and then the Central African Republic (CAR).
Liberia, Angola, Sierra Leone, Rwanda and Burundi have made the biggest improvements since 2000, while Madagascar, Eritrea, Guinea-Bissau, Somalia and Libya have deteriorated the most over that period.
There were huge disparities in the category marking rule of law and safety, which incorporates a number of indicators including judicial process, accountability and transparency, corruption, social unrest, violent crime, conflict and refugees. The highest-scoring country, Botswana, achieved 88.9 out of 100; Somalia, at the other end of the table, scored 4.9, while DRC and CAR scored 24.5 and 24.9 respectively.
Mali was among the five countries that experienced the biggest deterioration in the rule of law and safety since 2000. Its score in this category has declined steadily over the years, and dropped a further 10 points between 2011 and 2012, when the country experienced a food crisis and insurgency. Egypt’s score also dropped by seven points between 2011 and 2012.
Thirty-five of the 52 countries demonstrated improvements in the human rights and participation category since 2000, although the indicator looking specifically at rights recorded a decline, while those on participation rates and gender improved. The figures suggest that legislation enshrining people’s rights at international and national level has not necessarily translated into action.
About 90% of African countries made progress on sustainable economic opportunities, while all have improved their human development records since 2000.
The Mo Ibrahim Foundation defines governance as “the provision of the political, social and economic public goods and services that a citizen has the right to expect from his or her state, and that a state has the responsibility to deliver to its citizens”. The index is compiled using data from international and national sources, including representatives of government, business, academia, media and civil society.
For the first time, this year’s index includes data from the World Economic Forum global competitiveness report on issues including police services and the quality of education. The information includes input from business leaders, who are increasingly seen as essential to future development prospects.
The four categories are divided into 14 subsections and 94 indicators.
“This is the most accurate picture of what is going on in Africa, based on data, not personal views or political bias,” said Ibrahim, speaking at the study’s launch. “This is reality, a mirror put in front of Africa. This is not a time for African pessimism or optimism. These things are fashionable. This is the time to be realistic. We’re calling for Afro-realism.
“The picture is complex,” he added. “There are great achievements, but also challenges. We really need to focus on both of them.”
The former Irish president Mary Robinson, who is on the panel that awards the Ibrahim prize, added: “The focus of the MDGs [millennium development goals] is perhaps showing through. The weakness of those goals is they didn’t address rule of law and human rights.
“As we focus now on sustainable development goals, we need to bring in factors that address these issues. Health and education are important, but it’s worying that the very issues not improving are the ones that bring social cohesion and peace. It’s Afro-realism all right. There are real challenges there.”
Asked about the call by the African Union for the international criminal court to defer prosecution against sitting leaders, Ibrahim said the AU and the ICC need to sit down and discuss what would work best for both. He said while there can be no impunity, it was a “valid question” to ask why the only cases the ICC has brought have been against African leaders.
The Ibrahim prize for achievement in African leadership, established in 2007 and last won by President Pedro Pires of Cape Verde in 2011, was not awarded. The prize, awarded to a democratically elected former African head of state or government, provides winners with the opportunity to pursue their commitment to Africa once they have stepped down from office.
